Workers' Compensation Retaliation

Retaliating against an employee who has sought workers’ compensation benefits is illegal in Minnesota. Specifically, Minnesota prohibits “discharging or threatening to discharge” an employee for seeking workers’ compensation benefits, or in any manner intentionally obstructing an employee seeking workers’ compensation benefits. Employers can be sued for other adverse actions against an employee who has sought benefits, too, like demoting the employee, intimidating the employee, or cutting the employee’s hours.
